opening for the Barenaked Ladies, and police said the incident occurred following a Wednesday night show at the Alliant Energy Center near the campus of the University of Wisconsin at Madison.

"He apparently tried to stop a female from leaving his tour bus and some type of altercation ensued, and that's when we were contacted," Madison police officer Dan Merwin said. According to The Associated Press, the incident allegedly occurred when one of the women refused the 23-year-old Day's sexual advances. When her companion attempted to contact police, Day reportedly grabbed the woman's cell phone and smashed it.

Day was taken to the Dane County Jail early Thursday morning and released several hours later on $850 bail. Merwin said neither of the women was injured in the incident. Day was charged with three misdemeanors on Friday, including criminal damage to property, disorderly conduct and intimidation of a victim. He is due back in court on April 1.

"That was probably wrong of me," Day told police of breaking the phone, according to the AP. "But I felt violated." Day is touring in support of his 2003 album, Stop All the World Now.

A spokesperson for Day's label, Epic Records, could not be reached for comment at press time.
