The leader of the British post-punk band the Fall, who was arrested last Wednesday for assaulting the band's keyboard player, was ordered by a New York judge on Tuesday to enter an alcohol treatment program.

Quality Hotel Eastside on the afternoon of April 8 after allegedly kicking, punching and choking Julie Nagle, who is also his girlfriend.

The incident occurred prior to the final date on the band's recent East Coast tour. The alleged attack resulted in the cancellation of an appearance later that night at the Manhattan club Brownies.

Smith appeared in Manhattan criminal court to answer to the misdemeanor charge of assault in the third degree and was ordered to enter the treatment program, as well as to get anger management counseling, according to Wayne Brison, spokesperson for the Manhattan district attorney's office.

"He agreed to send the prosecutor a monthly update on his progress in the treatment and counseling programs," Brison said.

The judge also issued a limited order of protection for Nagle. "It was limited in the sense that they work together," Brison said, adding that the order covers all non-work-related interaction.

Smith's case is adjourned until Sept. 30, when, if he abides by the terms of the judge's conditions, a determination will be made as to how to proceed with the case, according to Brison.

Following his arrest last Wednesday, Smith was incarcerated until Friday, when he was released on $1,000 bail. Fans who showed up to Brownies on Wednesday night were greeted with a sign that said the band would not be performing for the second night of its two-night engagement.

Dee Pop, who booked the band's recent eight-date East Coast mini-tour and who is also the drummer in groove-rock band Bush Tetras, said last week that he had no idea what precipitated the incident.

"It seemed like every other day the shows were amazing or a spectacle," Pop said. "There were no real violent outbursts, although there were moments."

Pop described one recent show in which he said the band left the stage repeatedly and returned for erratic versions of its moody, arty rock. "[Smith] and the band are like cats and dogs," Pop added. "They fight all the time, depending on his mood."

Pop, who said he didn't want to comment on -- as he put it -- "Smith's problems," said the purpose of the showcase gigs in New Jersey, Washington, D.C., New York, Philadelphia and Boston was to lure label representatives in hope of getting a recording contract for the Fall in the U.S.
