Morgenthau. Smith, who was arrested last April after he allegedly attacked his girlfriend, Fall keyboardist Julia Nagle, at a New York hotel, appeared in City Criminal Court for a brief hearing Monday, Brison said. The case against him was adjourned until Aug. 21, at which point the charges could be dismissed.
