See, we want to make more jokes about families fighting on Thanksgiving (because humor is how we deal with sadness), but considering how bad this news story is getting, that might be a tad gauche. Accurate…but a tad gauche. After news broke that Halle Berry had obtained an emergency protective order against Gabriel Aubry following a Thanksgiving brawl at her home, the Cloud Atlas actress’s ex is now claiming that her current fiance Olivier Martinez attacked him first, in addition to threatening to kill him. According to TMZ, Aubry alleges in a legal declaration the French actor was enraged over the $3 million he and Berry allegedly lost in her custody battle over daughter Nahla, leading Martinez to attack Aubry in the driveway. Witnesses told police that it was actually Aubry who started the fight, though with all the screaming and flailing any normal person would be doing at such a time, it’s possible that certain details were unclear.
Leading credence to model Aubry’s claims, however, are the bruises he has been sporting since the incident. Obviously we weren’t at Halle Berry’s house during the brawl (thank goodness, because we doubt that situation needed more panicked screaming), but the idea that Olivier Martinez would demand Aubry move to Paris or “Olivier would kill him” seems a touch far-fetched. Or maybe that’s just us hoping this story isn’t as horrible as it seems. It was a holiday, for pete’s sake! We are not looking forward to Christmas, is all we’re saying.

Congratulations, Halle Berry! Also, we are so very sorry! According to TMZ, this must be one confusing time for the Dark Tide star. While Halle is allegedly officially betrothed to gentleman friend Olivier Martinez a month after engagement rumors first popped up, the actress also allegedly received death threats from a named Robert Hoskins. Berry allegedly feels so threatened by Hoskins that she is hoping to move with daughter Nahla Ariela to Martinez’s native France. Is there a card for complicated situations like this? You know what? Nevermind. We’ll just get one that’s blank on the inside.
Sadly this isn’t the first time Halle has had to deal with aggressive stalkers; last July Berry had to filed a restraining order against a man named Richard Franco after he broke into her home..twice. Seeing as how Hoskins is the very same man who was shot by Madonna‘s bodyguards while attempting to break into the singer’s home in 1995, we’d say Halle has every right to be terrified. Why do stalkers have to ruin every engagement? Or even one of them?

Halle Berry seems to be gearing up for an all-out brawl with baby daddy Gabriel Aubry over their daughter Nahla Ariela. For better or for worse, it will all have to wait until Monday. Following charges of battery and child endangerment filed by Nahla’s nanny Alliance Kamdem, the Academy Award-winner actress attempted to block her model ex from seeing Nahla until the investigation is over. Judge Scott Gordon instead opted to postpone their hearing until next week, when Judge Mark Juhas returns from vacation. Judge Juhas had been working on the case prior to his leaving for vacation, and will no doubt be thrilled to have it waiting on his desk when he gets back.
Meanwhile, the nanny was denied a restraining order against Aubry, despite her allegations that Berry’s ex yelled at, insulted and at one point shoved her in the presence of his child. Kamdem even goes so far as to claim that Gabriel once denied treatment for a rash Nahla developed. The judge presiding over her filing claimed that her petition was “insufficient and speculative.” Aubry’s rep reminds TMZ, “Anyone can file a police report at any time, regardless of it being accurate.” So which situation would be worse: that this is all a deliberate fabrication or that it’s the awful truth? Both, right? Both would be worse.
Ugh, and the day was going so well, too. According to TMZ, Halle Berry‘s ex Gabriel Aubry is being investigated for misdemeanor battery and misdemeanor child neglect after allegedly shoving and verbally attacking his nanny. According to their caregiver, who works for both Berry and Aubry, Halle’s ex pushed her into a door while arguing over why daughter Nahla Ariela was not taken to school by Aubry. The fact that the nanny was holding Gabriel and Halle’s daughter at the time of the altercation is what spurred a child endangerment investigation. It’s also spurring us to purse our lips together and shake our heads in utter dismay.
If you recall, Halle and Gabriel spent much of 2011 in and out of court in a dispute that seemed to be approaching a custody battle. We can’t imagine this will help such an already tense situation. More shoving almost never does.

When did Halle Berry‘s daughter Nahla Aubry get so big? Also, where did she get that excellent hat? Berry’s ex Gabriel Aubry carted their daughter around (literally) this week during a play date at a park in Los Angeles. The last time we checked in with Aubry was the last time he and Halle had custody beef in court this summer, so it’s nice to see him doing everyday dad stuff. For example, providing a means of conveyance and swing propulsion for the tiny person perched on his shoulders.
No matter who you are, celebrity or normal human being, one thing remains true: nothing is more boring than hanging out with your mom and her dumb boyfriend with no other kids around. The expression worn by Halle Berry’s daughter Nahla while the three-year-old visited Palma de Mallorca, Spain with mom Halle Berry and Berry’s boyfriend Olivier Martinez is priceless. It’s also the international expression for, “If we have to go to one more museum or cute little boutique, I will collapse onto this cobble stone street and I will lose my mind in front of a crowd of horrified bystanders.” At least Nahla has that tiny pink bear to keep her company. At least she has that.

In the past Halle Berry has said that court can be a helpful way for parents to work out issues. Maybe they can give her some sort of “Every 12 visit, you get one custody hearing free” card? Halle Berry’s custody battle with ex Gabriel Aubry has her back in front of a judge today. According to TMZ, Berry is meeting over concerns about Aubry’s parenting of their daughter Nahla Ariela Aubry; the actress is allegedly “claiming there was once an incident overseas when Gabriel allegedly neglected Nahla, imperiling her safety.” If you think Berry did not immediately know about it from 2,000 miles away through some sort of mom-specific Spidey sense, you have not been paying attention to their on-going drama at all.
In addition to her rocky custody battle, Berry’s career has had it’s ups and downs recently, the actress leaving then returning to New Year’s Eve, and recently getting replaced by Angela Bassett in Broadway play The Mountaintop. Here’s hoping both parties figure out a solution soon; that bailiff sees Halle Berry roughtly ten times more than paying audiences do.
Given how Halle Berry’s custody case with Gabriel Aubry threatened to go nuclear, we were both surprised and delighted when the couple declined to let things burst into publicly embarrassing flames, and Berry returned to New Year’s Eve filming. Just when you think someone is throwing gasoline on the fire, it turns out to be plain old water. Now that Halle and her ex can be in the same room with each other with flipping over tables, Berry opened up about her custody battle over her daughter Nahla, and how going to court can actually help you be a better parent. “When there’s a child involved, it’s a relief when you can resolve things in a good way,” Berry said in an interview with Extra. “Our issues were never about fighting for her. We both know a child needs both her parents.”
Earlier this year, their custody battle was awash with accusations that Halle was enraged that Gabriel Aubry went out with Kim Kardashian, as well as accusations of racial insensitivity and gold-diggery. According to Halle, taking things to the authorities is what eventually brought both parents to their senses. “But what I want to say about it is sometimes, as a couple, you reach an impasse,” Berry, currently dating Olivier Martinez, explained. “We need a court and a judge to help us work out some of the delicate issues, and I’m so happy we’ve arrived at that place — because for her sake, this is the best way. We both love her more than life.” Maybe Halle and Gabriel should just have a full-time judge around at all the family events, just in case: high school graduation, college graduation, Nahla’s wedding. Seems like paying his or her salary would be well worth fewer screaming matches.

Wow, we did not see this coming. According to RadarOnline, Gabriel Aubry is dropping his custody case against Halle Berry. Not only that, but he is withdrawing his request for spousal support as well. And without a single public screaming match or radio show meltdown! We’re stunned. “I think both sides realized how out of hand things had gotten recently,” an insider source claims. “They both love their daughter and want to make sure her well fare comes first.” We personally thought this feud would go on until the day their daughter Nahla turned 18, and even then she’d have to hear them complain about each other at Thanksgiving for the next fifty years.
The couple’s public feud over Nahla had been getting pretty heated, with allegations that Aubry objected to Nahla being called “black”, and Halle discussing her daughter’s race with Essence. “Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts,” the source continued. “Gabe’s decision to drop his case is his way of showing Halle he’s prepared to take a leap of faith and trust her once again.” According to TMZ, however, in the meantime Berry has won permission to take travel with Nahla, a hurdle that was keeping her from appearing in the new film New Year’s Eve. “We are pleased the judge took the time to deal with this very imminent and important issue. The judge read a great deal of paperwork and gave us time to argue,” said Berry’s lawyer Neal Hersh. “Halle is very pleased with the judge’s order.” We seriously hope this unsightly feud is almost over. If not, someone needs to watch these two in case they start exploring some King Solomon-type solutions to this mess.

Arguing about race and undergoing a custody battle seem like the two most unpleasant things imaginable, but it looks like Halle Berry is up to the challenge. The Monster’s Ball actress sat down with Ebony to confirm that Halle Berry considers daughter Nahla Black. Berry, who is biracial herself, discusses how people of mixed race have the right to self-identify, “But I feel like she’s Black. I’m Black and I’m her mother, and I believe in the one-drop theory.” Of course, Halle’s comments come after, and seemingly in response to, rumors that ex Gabriel Aubry doesn’t consider Nahla Black, in addition to allegedly calling Halle the N-word during their custody battle, which grows increasingly gruesome. We’re just hoping Nahla is in the other room with Dora the Explorer turned alllllllll the way up during this whole ordeal.
No matter her own feelings on the subject, Berry acknowledges that Nahla will have to come to her own conclusions about her own ethnic make-up. “What I think is that that’s something she’s going to have to decide,” Berry said. “I’m not going to put a label on it. I had to decide for myself, and that’s what she’s going to have to decide—how she identifies herself in the world. And I think, largely, that will be based on how the world identifies her. That’s how I identified myself.” Here’s hoping Nahla has the support of both parents as she navigates the tricky subject of race, though the fact they can’t be in the same room without getting into a screaming match isn’t going to be much help.
