SWEEPSTAKES RULES
VH1's Coldplay Flyaway Sweepstakes sponsored by EMI Records
1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. ALL ENTRIES, WHETHER THROUGH USE OF A VIRGIN MOBILE USA PHONE AS SET FORTH BELOW, VIA VH1.COM AS SET FORTH BELOW OR VIA 3"x 5" MAIL-IN ENTRY AS SET FORTH BELOW, HAVE AN EQUAL CHANCE OF WINNING.
2. To enter: (a) Website method of Entry: To enter the Sweepstakes it will be posted on VH1.com, a website owned and controlled by MTV Networks, a division of Viacom International, Inc. ("MTVN") starting at or around 12:00 pm (ET) April 16, 2003 and ending at 11:59 pm (ET) May 16, 2003 (the "Sweepstakes Period"). Participants must fill out the required fields on the Sweepstakes entry form on VH1.com to be entered into a random drawing (the "Website Entries"). (b) Wireless Method of Entry: To enter the Sweepstakes by using the VH1 Service on your Virgin Mobile USA wireless phone, play VH1's Rock Clock trivia game on your Virgin Mobile USA wireless phone and be entered to win during the Sweepstakes Period. You will automatically receive one entry into the Sweepstakes everyday you play Rock Clock during the Sweepstakes Period (the "Wireless Entries"). Entrants will be charged $.10 each time they answer a Rock Clock trivia game question on their Virgin Mobile USA wireless phone or (c) Mail-In Method of Entry: For participants who reside in an area where Virgin Mobile USA service is unavailable or for those who do not want to use the service or the Website method of Entry to participate, send a 3x5 postcard with your name, address, phone number, and age to "VH1's Coldplay Flyaway Sweepstakes," VH1, Promotions and Marketing, 1515 Broadway, 20th Floor, New York, NY 10036. One entry per each postcard completed as set forth herein and received during the Sweepstakes Period (the "Mail-In Entries"). (The Website Entries, the Wireless Entries and the Mail-in Entries, collectively referred to hereinafter as the "Eligible Entries"). All entries, regardless of method of entry must be received by 11:59PM (ET) on May 16, 2003. You may enter as often as you wish but each Mail-In Entry must be mailed separately and participants may only win one prize. All Mail-In Entries must be hand-printed. Illegible, incomplete, photocopied, printed by machine or otherwise mechanically reproduced entries will not be accepted. Incomplete or inaccurate entries are void. Your use of your Virgin Mobile USA phone to make a Wireless Entry, and/or your submission of a Mail-In Entry, constitutes your consent to participate in this Sweepstakes and for Virgin Mobile USA to obtain and deliver your name, address, phone number, email address and other information to MTVN for the sole purpose of administering this Sweepstakes. Eligible Entries received by 11:59PM (ET) on May 16, 2003 will be entered into a random drawing to determine one (1) grand prize winner (the "Grand Prize Winner"). By entering, participants acknowledge compliance with these official rules including all eligibility requirements. MTV Networks, a division of Viacom International Inc. ("MTVN"), CBS, Viacom International Inc., EMI Records and Virgin Mobile USA, LLC ("Virgin Mobile USA") and each of their respective agencies, are not responsible for late, lost, stolen, mutilated, postage due or misdirected entries or mail, or printing errors, or any problems or technical malfunctions of any telephone network or lines, computer on-line systems, telephone or Internet servers or providers, computer equipment, software, failure or delay of electronic communications, or traffic congestion on the Internet or at any Web site, or any human error which may occur in the processing of the entries in the Sweepstakes, or any combination thereof, including injury or damage to participants or to any other person's telephone equipment related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MTVN which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason MTVN deems it necessary, MTVN reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on VH1.com and within the VH1 Service on Virgin Mobile wireless phones and the prizes will be awarded based on a random drawing that MTVN will conduct from among all Eligible Entries received as of the date of termination. Entries that have been tampered with or altered are void. In the event of a dispute over who submitted a Wireless Entry, such entry will be declared made by the authorized account holder of the telephone number, pager number or email address submitted at the time of entry. An "authorized account holder" is defined as the natural person who is assigned to a telephone number, pager number or email address by a telephone company, wireless service provider, Internet access provider, Internet service provider, or other organization (e.g. business, educational, government, institution, etc.) that is responsible for assigning telephone numbers, pager numbers, wireless phone numbers, email addresses, for the telephone exchange associated with the submitted telephone or pager number or the domain associated with the submitted telephone, pager number or email address, as applicable.
3. Prizing: One (1) Grand Prize Winner will receive a prize (the "Grand Prize") including:
- Round trip coach air transportation for Grand Prize Winner and one (1) guest from an airport near Grand Prize Winner's residence of MTVN's choice to the city where the Coldplay concert will take place; (MTVN reserves the right to substitute ground transportation for air transportation if the Grand Prize Winner resides within 150 miles of location of concert);
- Two (2) tickets to the Coldplay concert;
- Two (2) nights hotel accommodations for Grand Prize Winner and one (1) guest in the city of the concert (Single room based on double occupancy, room and tax only; meals, telephone calls and other incidentals not included);
- Roundtrip ground transportation for Grand Prize Winner and one (1) guest between hotel and airport in the city of the concert
The estimated retail value of the Grand Prize is $2,500.
4. The tentative dates for prize fulfillment are between May 17 - September 31, 2004 and are subject to change at MTVN's sole discretion. Total approximate retail value of this Sweepstakes is $2,500. The actual retail value of this Sweepstakes depends on current existing market conditions at time of prize fulfillment. Grand Prize Winner and guest must be available to travel on the dates selected by MTVN. In the event a chosen Grand Prize Winner is unable to travel on such dates as determined by MTVN, such Grand Prize Winner of VH1's Coldplay Flyaway Sweepstakes and all privileges as a Grand Prize Winner will immediately be terminated. An alternate winner may be selected at random by MTVN from among all of the remaining Eligible Entries received. Some restrictions may apply.
5. Odds of winning will be determined by the total number of Eligible Entries received.
6. By participating in this Sweepstakes, entrants agree to be bound by these rules and by the decisions of MTVN, which are final in all matters relating to this Sweepstakes.
7. The Grand Prize Winner will be chosen at random from among all Eligible Entries received by MTVN on or about May 17, 2003. MTVN will attempt to contact the potential Grand Prize Winner by phone or e-mail. Potential Grand Prize Winners who entered using a Virgin Mobile USA phone will be contacted by text message and/or phone, and if such entrant's Virgin Mobile USA phone is no longer active at the time of winner notification, such entrant will be contacted using the contact phone number provided by entrant upon activation of such entrant's account with Virgin Mobile USA or subsequently provided to Virgin Mobile USA through the Virgin Mobile USA account management tool. Note, to keep a Virgin Mobile USA phone active, user must top-up the account by at least $20 every 90 days or account will become inactive. Upon notification, the potential Grand Prize Winner must call the phone number provided to confirm identity and eligibility within forty-eight hours of notification. If any potential Grand Prize Winner is unreachable, or if there is no response from any potential Grand Prize Winner, an alternate potential Grand Prize Winner may be chosen, in MTVN's sole discretion. If an alternate potential Grand Prize Winner is chosen, it will be selected randomly from the remaining Eligible Entries.
8. The specifics of all elements of any prize in the Sweepstakes shall be solely determined by MTVN. Some restrictions may apply. No substitution, transfer of any prize (or any part of a prize package) or cash alternative permitted, except by MTVN due to prize unavailability at time of award in which case a prize of equal or greater value will be awarded. Unless specified otherwise by MTVN, no cash will be awarded. Arrangements for the fulfillment of prizes will be made by MTVN. In order to be eligible to receive any prize components of this Sweepstakes, the Grand Prize Winner and his/her guest must each sign (a) an affidavit of eligibility and release of MTVN, CBS, Viacom International Inc., EMI Records, Virgin Mobile USA, and their respective officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, claims, demands, and causes of action for personal injury and/or death, damage, theft, or loss suffered in connection with this promotion or the use or acceptance of the prize or any portion thereof (including, without limitation, any travel, flight or activity related thereto) ; and (b) where permitted, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation; entry into this Sweepstakes constitutes each Grand Prize Winner's and his/her guest's agreement to sign such releases. The Grand Prize Winner must also complete, and require guest to complete, all legal documents and return them to MTVN within forty-eight hours after receipt of such documents. Noncompliance will result in disqualification of the Grand Prize Winner and an alternate winner may be selected from among all remaining eligible entries, in MTVN's sole discretion. The receipt by the Grand Prize Winner of any of the prize components of this Sweepstakes is conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE GRAND PRIZE WINNER (AT MTVN'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS THE GRAND PRIZE WINNER OF "VH1's COLDPLAY FLYAWAY SWEEPSTAKES SPONSORED BY EMI RECORDS " SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
9. The value of the Grand Prize may be taxable as income to Grand Prize Winner. Upon receipt of the prize, the Grand Prize Winner is required to comply with any and all applicable federal, state and local tax that becomes due with respect to the Grand Prize.
10. Sweepstakes is open to residents of the 48 contiguous United States who are at least 21 years of age at time of entry. The Grand Prize Winner and his/her guest are subject to proving eligibility, including verification of social security numbers. If Grand Prize Winner cannot furnish verifiable and valid proof of age within forty-eight hours after being notified of winning, an alternate winner may be chosen from among all remaining eligible entries received, in MTVN's sole discretion. Sweepstakes not open to employees and their immediate families of MTVN, MTV Networks, Viacom International Inc., CBS, Virgin Mobile USA, and their respective affiliated companies and subsidiaries as well as any person who has won an MTVN national contest or sweepstakes in the 2003 calendar year. VOID IN ALASKA AND HAWAII OR WHEREVER PROHIBITED OR RESTRICTED BY LAW. All Mail-In Entries and Website Entries become the property of MTVN. Additional restrictions may apply.
11. All interpretations of the rules and decisions by MTVN are final. MTVN reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
12. For a copy of the winners list or the Official Rules, send a self-addressed, stamped envelope ("SASE") to: VH1.com, Attn: Promotions and Marketing Department, " VH1's Coldplay Flyaway Sweepstakes, 1515 Broadway, 20th Floor, New York, NY 10036. All requests must be received by June 30, 2003. Please note on the front left hand corner of your outer envelope whether you are requesting "Rules" or the name of the "Winner". Vermont residents may omit return postage if requesting a set of Official Rules.
13. Grand Prize Winners agrees that MTV Networks, Viacom International Inc., CBS, EMI Records, Virgin Mobile USA and each of their respective subsidiaries, affiliates, related companies, officers, directors and employees shall have no liability in connection with acceptance or use of any of the prizes awarded herein.
14. This Sweepstakes is sponsored by MTVN Networks, a division of Viacom International, Inc. and EMI Records.
