SWEEPSTAKES RULES
VH1's "Divas Take Over Vegas" Sweepstakes
Sponsored by T-Mobile, Baileys and P&G
1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. ALL ENTRIES, REGARDLESS OF THE METHOD OF ENTRY USED, HAVE AN EQUAL CHANCE OF WINNING. YOU MUST BE 21 YEARS OF AGE OR OLDER AND BE A LEGAL RESIDENT OF THE CONTINENTAL UNITED STATES. VOID IN CALIFORNIA, ALASKA, HAWAII, TENNESSEE AND WHEREVER PROHIBITED BY LAW.
2. To enter: log on to VH1.com, a website owned and controlled by MTVN Networks, a division of Viacom International Inc ("MTVN") between 12:00PM (ET) on March 16, 2004 and 12:00 PM (ET) on April 5, 2004 (the "Sweepstakes Period")and fill out the required fields on the Sweepstakes entry page and submit as instructed. Entries submitted in accordance with these Official Rules and received by MTVN during the Sweepstakes Period shall be hereinafter referred to as the "Eligible Entries". Entries, be received by 12:00 PM (ET) on April 5, 2004. You may enter as often as you wish but you may only win one prize. Eligible Entries will be entered into a random drawing to determine one (1) grand prize winner (the "Grand Prize Winner"). By entering, participants acknowledge compliance with these Official Rules including all eligibility requirements. MTV Networks, a division of Viacom International Inc., CBS, Viacom International Inc., T-Mobile USA, Inc. ("T-Mobile"), Baileys and Procter & Gamble ("P&G") and each of their respective agencies, are not responsible for late, or lost entries or any problems or technical malfunctions of any telephone network or lines, computer on-line systems, telephone or Internet servers or providers, computer equipment, software, failure or delay of electronic communications, or traffic congestion on the Internet or at any website, or any human error which may occur in the processing of the entries in the Sweepstakes, or any combination thereof, including injury or damage to participants or to any other person's telephone equipment related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MTVN which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason MTVN deems it necessary, including without limitation changes in the scheduling of or cancellation of the 2004 Divas concert, MTVN reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on Vh1.com and the prizes may be awarded based on a random drawing that MTVN will conduct from among all Eligible Entries received as of the date of termination. Entries that have been tampered with or altered are void. In the event of a dispute over who submitted an entry, such entry will be declared made by the authorized account holder of the email address submitted at the time of entry. An "authorized account holder" is defined as the natural person who is assigned to a telephone number, pager number or email address by a telephone company, wireless service provider, Internet access provider, Internet service provider, or other organization (e.g. business, educational, government, institution, etc.) that is responsible for assigning telephone numbers, pager numbers, wireless phone numbers, email addresses, for the telephone exchange associated with the submitted telephone or pager number or the domain associated with the submitted telephone, pager number or email address, as applicable.
3. Prizing: One (1) Grand Prize Winner will receive a trip for six to Las Vegas, NV to attend the 2004 Divas concert including:
· (a) roundtrip air transportation for Grand Prize Winner and five (5) guests (each a "Guest")from an airport near Grand Prize Winner's residence of MTVN's choice to Las Vegas, NV; (MTVN reserves the right to substitute ground transportation for air transportation if the Grand Prize Winner resides within 150 miles of Las Vegas); (b) three (3) night hotel accommodations for Grand Prize Winner and Guests(three rooms based on double occupancy, room and tax only; meals, telephone calls and other incidentals not included); (c) "VIP" access for Grand Prize Winner to the 2004 Divas red carpet; (d) "VIP" access into 3-5 Las Vegas nightclubs for Grand Prize Winner and Guests; (e) one (1) spa treatment for Grand Prize Winner; (f) one (1) Motorola V300 camera phone with wireless service to be provided by T-Mobile for one year; and six (6) tickets to the 2004 Divas concert. (the foregoing, the "Grand Prize")
· No part of the Grand Prize includes beer or alcoholic beverages. The specifics of each of the elements of the Grand Prize shall be solely determined by MTVN. The total estimated retail value of the Grand Prize is $8,810.
4. The tentative date by which the Grand Prize will be fulfilled is on or around April 16, 2004 and are subject to change at MTVN's sole discretion. The actual retail value of this Sweepstakes depends on current existing market conditions at time of prize fulfillment. Grand Prize Winner and guest must be available to travel on the dates selected by MTVN. In the event a chosen Grand Prize Winner is unable to travel on such dates as determined by MTVN, such Grand Prize Winner of VH1's "Divas Take Over Vegas" Sweepstakes sponsored by T- Mobile, Baileys and P&G and all privileges as a Grand Prize Winner will immediately be terminated. An alternate winner may be selected at random by MTVN from among all of the remaining Eligible Entries received. Some restrictions may apply.
5. Odds of winning will be determined by the total number of Eligible Entries received.
6. By participating in this Sweepstakes, entrants agree to be bound by these rules and by the decisions of MTVN, which are final in all matters relating to this Sweepstakes.
7. The Grand Prize Winner will be chosen at random from among all Eligible Entries received by an independent judging organization on MTVN's behalf on or around April 6, 2004. The Grand Prize Winner will be contacted by telephone. Upon notification, the potential Grand Prize Winner must confirm identity and eligibility within forty-eight hours of notification. If any potential Grand Prize Winner is unreachable (no messages will be left), or if there is no response from any potential Grand Prize Winner, an alternate potential Grand Prize Winner may be chosen, in MTVN's sole discretion. If an alternate potential Grand Prize Winner is chosen, it will be selected randomly from the remaining Eligible Entries.
8. The specifics of all elements of any prize in the Sweepstakes shall be solely determined by MTVN. Some restrictions may apply. No substitution, transfer of any prize (or any part of a prize package) or cash alternative permitted, except by MTVN due to prize unavailability at time of award in which case a prize of equal or greater value will be awarded. Unless specified otherwise by MTVN, no cash will be awarded. Arrangements for the fulfillment of prizes will be made by MTVN and T-Mobile USA, Inc. In order to be eligible to receive any prize components of this Sweepstakes, the Grand Prize Winner and his/her guest must each sign (a) an affidavit of eligibility and release of MTVN, CBS, Viacom International Inc., T-Mobile USA, Inc. Baileys, Procter & Gamble and each of their respective officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, claims, demands, and causes of action for personal injury and/or death, damage, theft, or loss suffered in connection with this Sweepstakes or the use or acceptance of the prize or any portion thereof (including, without limitation, any travel, flight or activity related thereto); and (b) where permitted, a promotional release granting MTVN and Mobile the right to use his or her name and likeness for advertising and publicity purposes without additional compensation; entry into this Sweepstakes constitutes Grand Prize Winner's and his/her Guests' agreement to sign such releases. Grand Prize Winner must also complete, and require guest to complete, all of the foregoing legal documents and return them to MTVN within three working days after receipt of such documents. Noncompliance will result in disqualification of the Grand Prize Winner and an alternate winner may be selected from among all remaining eligible entries, in MTVN's sole discretion. The receipt by the Grand Prize Winner of any of the prize components of this Sweepstakes is conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE GRAND PRIZE WINNER (AT MTVN'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS THE GRAND PRIZE WINNER OF "VH1's "DIVAS TAKE OVER LAS VEGAS" SWEEPSTAKES SPONSORED BY T- MOBILE, BAILEYS AND P&G" AND ALL PRIVILEGES AS GRAND PRIZE WINNER WILL BE IMMEDIATELY TERMINATED.
9. All taxes on the Grand Prize as well as any expenses which are not expressly described herein are the Grand Prize Winner's sole responsibility. Upon receipt of the prize, the Grand Prize Winner is required to comply with any and all applicable federal, state and local taxes that become due with respect to the Grand Prize.
10. Sweepstakes is open to legal residents of the United States, excluding Alaska, California, Hawaii, and Tennessee, who are at least 21 years of age at time of entry. Guests traveling with the Grand Prize Winner must be at least 21 years of age at time of prize fulfillment. Grand Prize Winner and his/her Guests are subject to proving eligibility, including verification of social security numbers. If Grand Prize Winner cannot furnish verifiable and valid proof of age within forty-eight hours after being notified of winning, an alternate winner may be chosen from among all remaining eligible entries received, in MTVN's sole discretion. Sweepstakes not open to employees and their immediate families of MTV Networks, Viacom International Inc., CBS, T- Mobile USA, Baileys, Procter & Gamble and each of their respective affiliated companies and subsidiaries as well as any person who has won an MTVN national contest or sweepstakes in the 2004 calendar year. VOID IN ALASKA, CALIFORNIA HAWAII AND TENNESSEE OR WHEREVER PROHIBITED OR RESTRICTED BY LAW. All entries become the property of MTVN. Additional restrictions may apply.
11. All interpretations of the rules and decisions by MTVN are final. MTVN reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
12. For a copy of the winners list or the Official Rules, send a self-addressed, stamped envelope to: VH1 Integrated Marketing, Attn: VH1's "Divas Take Over Vegas" Sweepstakes", 1515 Broadway, 20th Floor, New York, NY 10036. All requests must be received by May 31, 2004. Please note on the front left hand corner of your outer envelope whether you are requesting "Rules" or the name of the "Winner". Vermont residents may omit return postage if requesting a set of Official Rules.
13. Grand Prize Winner agrees that MTV Networks, Viacom International Inc., CBS, T- Mobile, Baileys, Procter & Gamble and each of their respective subsidiaries, affiliates, related companies and employees shall have no liability in connection with acceptance or use of any of the prizes awarded herein.
14. This Sweepstakes is sponsored by MTVN Networks, a division of Viacom International Inc.; T-Mobile USA, Inc., Baileys and Procter & Gamble.
