SWEEPSTAKES RULES
The "VH1 Cingular Golf Getaway" Sweepstakes, sponsored by Cingular
1. No purchase necessary.
To enter: The sweepstakes will be posted on www.VH1.com, a website owned and controlled by MTV Networks ("MTVN") starting at or around 12:00 noon (ET) April 1, 2003 and ending at or around 11:59pm (ET) April 12, 2003. Entrants will be entered into the sweepstakes by submitting an answer to the following question: "Out of these four people, who is most likely to sink the Cingular Million Dollar Hole-In-One?" Possible answers are: (A) Adrian Young, (B) Cheech Marin, (C) Alice Cooper, (D) Brett Michaels or (E) None of the Above. There are three methods of entry: (i) Cingular wireless customers can enter by text messaging their answer to phone number 841 on their Cingular Wireless phone. Cingular wireless voting will be open from 12:00 noon (ET) April 1, 2003 to 11:59pm (ET) April 12, 2003; (ii) online participants must fill out the required fields on the Sweepstakes entry form on VH1.com to enter sweepstakes which will be available from 12:00 noon (ET) April 1, 2003 to 11:59pm (ET) April 12, 2003 ; (iii) mail in entries can be sent to "VH1 Cingular Golf Getaway Sweepstakes", VH1 Marketing, 1515 Broadway, 20th Floor, New York, NY 10036. All mail in entries must be postmarked no later than April 12, 2003. Entrants will be given the opportunity to receive an extra entry by answering the question correctly. All wireless entries, online entries and mail in entries will be entered into a random drawing (collectively "Eligible Entries"). There will be one Grand Prize winner (the "Grand Prize Winner") selected from all of the Eligible Entries received. Participants must complete all required data requested on the entry form. Incomplete or inaccurate entry forms are void. Limit one entry per person per day. If an entrant uses multiple e-mail addresses to submit more than one online entry for a given day, only the first online entry for that day will count. By entering, participants acknowledge compliance with these official rules including all eligibility requirements. MTVN and Cingular are not responsible for any problems or technical malfunctions of any telephone network (including wireless networks) or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MTVN or Cingular which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason MTVN deems it necessary, MTVN reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on www.vh1.com. Entries that have been tampered with or altered are void. In the event of a dispute over who submitted the winning entry, the holder of the winning email account will be declared the winner.
2. Prizing:
One Grand Prize Winner will be eligible to receive one of two prize packages offered (the "Grand Prize"). The Grand Prize will consist of either a fly away package (the "Fairway to Heaven Package") or a cash prize (the "Cash Prize") as follows:
The Fairway to Heaven Package:
- Roundtrip coach air transportation for the Grand Prize Winner and one (1) guest from an airport near winner's residence of MTVN's choice to VH1's Fairway to Heaven event in Miami, Florida. (estimated retail value: approximately $450 each; $900 total)
- Two (2) night hotel accommodations for Grand Prize Winner and one (1) guest (one room, double occupancy, room and tax only; meals, telephone calls and other incidentals not included) (estimated retail value: approximately $250 each night; $500 total)
THE TOTAL ESTIMATED RETAIL VALUE OF THE GRAND PRIZE IS $1,400.
The Cash Prize:
- The Cash Prize shall consist of $2,000 cash. In no way can the grand prize and cash alternative grand prize be combined.
TOTAL RETAIL VALUE OF THE CASH PRIZE IS $2,000.
The tentative date for prize fulfillment for First Prize winners is March 31, 2004 and is subject to change at MTVN's sole discretion. Total approximate retail value of this Sweepstakes is between $1,400 - $2,000 (maximum), depending on grand prize option chosen. The actual retail value of this Sweepstakes depends on current existing market conditions at time of prize fulfillment. MTVN reserves the right to substitute any prize with prize(s) of comparable value. In the event a Grand Prize Winner is unable to travel on such dates as determined by MTVN (and does not wish to receive the $2,000 cash alternative), such Grand Prize Winner will be disqualified and all privileges as a Grand Prize Winner will immediately be terminated. An alternate winner may be selected instead from among all of the remaining Eligible Entries received. Some restrictions may apply.
3. Odds of winning will be determined by the total number of eligible entries received.
4. By participating in this Sweepstakes, entrants agree to be bound by these rules and by the decisions of MTVN which are final in all matters relating to this Sweepstakes.
5. The Grand Prize Winner will be chosen at random, from among all of the Eligible Entries received, by VH1.com on MTVN's behalf on or around April 21, 2003. VH1.com and/or MTVN will be contacting each potential Grand Prize Winner by phone and/or email. Upon notification, each potential winner must call the phone number provided to confirm identity and eligibility within two (2) working days. If any potential winner(s) is unreachable, or if there is no response from any potential winner(s), an alternate winner(s) may be chosen, in MTVN's sole discretion. If an alternate winner is chosen, it will be selected randomly from the remaining Eligible Entries.
6. The specifics of all elements of any prize in the Sweepstakes shall be solely determined by MTVN. Some restrictions may apply. No substitution, transfer of any prize (or any part of a prize package) or cash alternative permitted, except by MTVN due to prize unavailability at time of award in which case a prize of equal or greater value will be awarded. Unless specified otherwise by MTVN, no cash will be awarded. Arrangements for the fulfillment of prizes will be made by MTVN. The winners and one (1) guest must sign (a) an affidavit of eligibility and release of MTVN, MTV Networks, CBS, Viacom International Inc. and Cingular from any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this promotion or the use or acceptance of the prize or any portion thereof to be eligible for the prizes; and (b) where permitted, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation; entry into this Sweepstakes constitutes each Prize winner's and his/her guest agreement to sign such release. Each Prize Winner must also complete, and require guest to complete, all legal documents and return them to MTVN within three (3) working days after receipt of such documents. Noncompliance will result in disqualification of the Prize Winner and an alternate winner may be selected from among all remaining eligible entries, in MTVN's sole discretion. The receipt by any winner of any of the prize components of this Sweepstakes is conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT MTVN'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE "VH1 Cingular Golf Getaway Sweepstakes" AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
7. The value of the prize(s) may be taxable as income. Upon receipt of any prize, each winner is required to comply with any and all applicable federal, state and local tax that becomes due with respect to the prize(s).
8. Sweepstakes entrants must be legal residents of the U.S. 21 years of age or older at the time of entry. If entering via VH1.com and/or Cingular Wireless, entrants must have an active online or wireless account as of April 1, 2003. All guests must be 21 years of age or older at time of prize fulfillment. Winner and guest are subject to proving eligibility, including verification of social security number. If Winners cannot furnish verifiable and valid proof of age within 48 hours after being notified of winning, an alternate winner may be chosen from among all remaining eligible entries received, in MTVN's sole discretion. Sweepstakes not open to employees and their immediate families of MTV Networks, Viacom International Inc.,CBS, Cingular, affiliated companies and subsidiaries as well as any person who has won an MTV Networks national contest or sweepstakes between the April 13, 2002 and April 12, 2003 calendar year. Winners subject to proving eligibility. VOID IN ALASKA AND HAWAII AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. All entries become the property of MTVN. Additional restrictions may apply.
9. All interpretations of the rules and decisions by MTVN are final. MTVN reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE, THE CINGULAR WIRELESS NETWORK OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
10. For a copy of the winners list, send a SASE to: MTV Online, Attn: VH1 Marketing and Promotions Department, The "VH1 Cingular Golf Getaway" 1515 Broadway, 20th Floor, New York, NY 10036. All requests must be received by November 1, 2003.
11. Winners agree that MTV Networks, Viacom International Inc., Central Broadcasting System (CBS), Cingular, their subsidiaries, affiliates, related companies and employees shall have no liability in connection with acceptance or use of any of the prizes awarded herein.
12. This Sweepstakes is sponsored by MTVN, and Cingular.
